How long do I need to be separated before I can divorce?
In Australia you generally need to be separated for at least 12 months before you can apply for a divorce. You can be separated while still living under the same roof in some cases. We can talk you through whether you meet the requirements and handle the application for you.
How is property divided after separation?
There is no fixed formula. The court considers the assets and debts of both parties, the contributions each of you made, and your future needs, to reach a division that is just and equitable. We help you understand how this applies to your situation and work towards a fair outcome.
What happens with the children?
Any decision about children is guided by their best interests. That covers their safety, their relationships with both parents, and their emotional and developmental needs. We help you reach workable parenting arrangements and, where necessary, seek parenting orders.
Do we have to go to court?
